In 1963, Dr. K.M. Munshi, a key member of the Drafting Committee of the Indian Constituent Assembly, brought out this book on the "The President Under The Indian Constitution", in pursuance of a question raised on the constitutional position of the President by Dr. Rajendra Prasad, Free India's first President, who served two terms (1948-53 and 1953-58).
Dr. Munshi has set out in simple and lucid language the position and powers of the President under our Constitution. He has pointed out that the President "was not only to be the highest dignitary of the realm, but the embodiment of the unity of the country... His principal role was 'to prevent a parliamentary government from becoming parliamentary anarchy'... It is the Presidential authority that keeps the country and people constitutionally bound together... For the whole country his authority runs like a golden thread throughout the Constitution."
Luckily, our Constitution was drafted by men, not elected on the basis of adult franchise, but by hand-picked men of vision and knowledge, coupled with an uncanny foresight of the harsh times which would face the country in the unfolding future. Few people realize that a high moral tone is of the essence of our Constitution.
The picture of India that emerges today is of a great nation in a state of moral decay.
Tall men dominated the scene, fifty years ago, in place of the pygmies who strut and fret their hour upon the stage today. We are living in an age when far too many men in our political life have proved themselves to be boneless wonders, having no sense of guilt or shame. Horse-trading in politics and toppling of governments have become national pastimes.
It is at such times (when "parliamentary government" becomes "parliamentary anarchy"), that the citizens of India look up to the President for his wise counsel. The President has to make value-based decisions that democracy may survive in India beyond our own times and in the days when our place will know us no more.
