Past decade has seen many legal changes in many fields like that of Environment, Family laws, Criminal law, Civil Procedure Code, Law of Property and so on and of these the law that stands out is the right to know i.e. Freedom of speech and expression. It is one of the fundamental Right embossed in Part-III of the Indian Constitution in Article 19(1)(a).
"Legal Aspects of Rights and Responsibility of the Press in India" is the topic of the current study. The purpose for choosing this topic for this study is manifold, i.e. the role played by the Press in a democratic set up.
Democracy, we know, is governance by the people; there are representatives of the people, both at the centre as well as at the State level, and these representatives are the instruments in the governance of the country.
Press, the fourth estate, has its own influential liabilities to burden, under a representative form of political setup, and with such liabilities this estate is required to achieve certain objectives.
Under above mentioned circumstances, what are the rules, scopes, objectives, liberties, restraints, liabilities and privilege of the Press and those connected with it, is the subject matter of this study.
The study elaborates the 'evolution' of the Press Freedom and tread through to study how this freedom is acquired. What is the existing condition and what are the reforms needed to make the Press more responsible, covering major population which in tura will emancipate the darkness which looms. Also the need for the change in certain existing Act, like Official Secrets Act, which still bears the mark of 'imperialism'.
I hope this little effort will help to motivate the need for changes in existing law which more or less regulate and curtail freedom of the Press. The country certainly needs citizens who understand that the 'Responsible Press' is the surest guarantee of durable and happy government in the State.
I am deeply conscious of the difficulty of the task attempted here. The field today has become large and even the most comprehensive approach must remain fragmentary. The law too does not stand still. References have been included but my tone of effort rests on the case laws. As a student I am conscious of the inadequacy of my knowledge at places where symposium could not be a substitute for a book that must reflect one's approach.
Every reader will find something missing. A partial explanation is that a number of matter to the present book have been discussed by various authors and I did not want to duplicate it.
